PROVENCE DAYS, 364A rue des Poulivets, Place Felix Autard, 84580 Oppede, France, and managed by Mr Mark Hopkins holder of the professional card n° CPI 8401 2016 000 009 265 issued by the Préfecture de Vaucluse on 24 March 2015 and guaranteed by the Caisse de Garantie de l’Immobilier Galian, 89 rue de La Boétie 75008 Paris, France, offers to owners of holiday rental properties:
– to advertise on his website www.provencedays.com a property for rent;
– to provide a secure online payment service.
PROVENCE DAYS cannot be held responsible beyond the limit of these services.
PROVENCE DAYS cannot be responsible for a case of force majeure including but not limited to strikes, lock-outs and other industrial action, breakdowns of systems or internet, flood, fire, explosions and other accidents.
You agree that in using the site you confirm that you have read, understood and accept to be bound by these conditions.
Commitment of the rental owner
a) The rental owner:
– agrees to supply the property according to the conditions and rates agreed with PROVENCE DAYS.
– agrees to maintain the standard of the property,
– guarantees that all equipment complies with the relevant regulations and standards,
– agrees to maintain the property to a good standard of cleanliness,
– agrees to ensure the quiet enjoyment of the rented property.
b) The rental owner certifies that the description and photos of a property give an accurate impression of the property.
c) The rental owner declares that the pool has a security system that conforms to current regulations.
a) All reservations made through PROVENCE DAYS are made with the payment of a 25% booking deposit taken 6 months before the reservation. The remaining 75% is to be paid at least 30 days before the start of the rental period. If the reservation is made within 30 days of the start of the rental period, the full amount will be paid on booking, as well as any additional costs.
Monies paid will be held in a sequestered bank account, in the name of Mr Mark Hopkins trading as PROVENCE DAYS, 346A rue des Poulivets, Place Felix Autard, 84580 Oppede, France.
b) A contract between owner and renter exists as soon the owner confirms availability, either orally or by electronic communication, and the appropriate payment is received. A reservation will be accepted only once a booking deposit is received and banked, and the rental contract received by PROVENCE DAYS, signed and initialled by the renter.
c) PROVENCE DAYS will provide the directions to the property and coordinates for the contact person.
An inventory check will be made by the owner, or a person he has authorised, with the renter on arrival and departure.
The owner may also under his own responsiblity and outside the accountability of PROVENCE DAYS ask for a security deposit on the renter’s arrival, to be returned at the end of the rental, if no damage to the property or its contents is observed. In the case where damage is observed the security deposit can be retained in order to cover the cost of repair or replacement, and if the amount of the security deposit is inadequate to cover the full cost, the owner is entitled to seek full reimbursement from the renter.
The owner has up to 2 weeks to return the security deposit to the renter, from the moment the keys are returned.
Changes to and cancellation of a reservation
Once a reservation is confirmed this becomes firm and definitive, however, PROVENCE DAYS will endeavour to re-book following a cancellation, and if a re-booking is achieved there will be a reimbursement of monies paid, minus bank charges.
If a renter wants to change or cancel a reservation, they should contact PROVENCE DAYS by phone, followed by an email.
All material and software used by PROVENCE DAYS on www.provencedays.com and all websites owned and controlled by PROVENCE DAYS are copyright protected. A user must not copy, transmit, modify, republish, save, pass off or link to any content or material on PROVENCE DAYS’s websites without the prior written approval of PROVENCE DAYS .
Failure to do so leaves the user open to legal pursuit.
All text, data and/or images created by PROVENCE DAYS, or supplied by an owner to PROVENCE DAYS, is the intellectual property of PROVENCE DAYS .
Use of the user’s personal information
a) PROVENCE DAYS reserves the right to use and share user information, including IP address, with relevant authorities, in accordance with legal requirements.
b) PROVENCE DAYS reserves the right to share information with companies in the same sector as PROVENCE DAYS within the framework of fraud prevention.
PROVENCE DAYS cannot be held responsible for any act of data breach or hacking of its websites or email programs.
Changes to the PROVENCE DAYS websites
PROVENCE DAYS reserves the right to modify, change, suspend or interrupt any aspect of its websites, whether for legal, commercial or technical reasons.
It might be that the websites of PROVENCE DAYS are inaccessible for technical reasons, and in that case PROVENCE DAYS will use reasonable skill and care to overcome these temporary suspensions, where they are within PROVENCE DAYS’s control, without being held liable for such suspensions.
In the case of any dispute, the parties will, prior to any legal action, seek an amicable solution, using a mediator of their choosing.
If no amicable solution can be found, the Tribunal de Commerce d’Avignon will be the court of competent jurisdiction.
Covid-19 Cancellation policy
At Provence Days we believe in doing the right thing by our customers having to cancel their holiday plans. We will fully refund any payments or transfer the holiday to a later date depending on the customer’s wishes.
This assurance comes into effect under the following circumstances:
- French or home country government ‘State of Emergency’ or ‘Lock down’, making it impossible to travel to or within France to reach the rental.
- Home country advice against non-essential travel to France.
- French government restrictions making rentals impossible.
Please note any other costs of your holiday will not be covered by Provence Days should there be the need for a cancellation.
The customer will have the option to cancel their holiday with a full refund or move their holiday to a later date.
